Description
It is an authorization of temporary residence due to exceptional circumstances This permit may be granted to foreign nationals who are in Spain and who held a residence authorization that was not granted due to exceptional circumstances in the two years immediately preceding the date of application, and whose renewal was not granted for reasons other than public order, security, and public health. However, it will be possible to apply even if there is a court ruling denying the application, dismissing the case, or acquitting the defendant.
Requirements
- Not being a citizen of a European Union State, from the European Economic Area or Switzerland, or a family member of citizens of these countries to whom the Union citizen regime applies.
- Being in Spain and not having the status of applicant for international protection at the time of submission of the application or during its processing.
- Having remained in national territory continuously for at least the two years prior to the submission of said application. For these purposes, when the foreign person has been an applicant for international protection, the time spent in Spain during the processing of the application for international protection until its final resolution in administrative and, where applicable, judicial proceedings will not be counted.
- Not to pose a threat to public order, safety, or public health.
- Having no criminal record in Spain and in the countries where he has resided for the last five years, for crimes existing in the Spanish legal system.
- Not to be listed as rejectable in the territorial space of countries with which Spain has signed an agreement in this regard.
- Not to be found, where applicable, within the period of commitment not to return to Spain.
- Pay the fee corresponding to the processing of the procedure.
Required documentation
- Application form in official model (EX-10) , duly completed and signed by the foreign person.
- Full copy of passport, travel document or registration certificate.
- Documentation proving continuous residence in Spain for a minimum period of two years.
- Criminal record certificate issued by the Authorities of the country or countries in which you have resided during the five years prior to entering Spain.
- Mandate in favor of the manager.
