Description

It is an authorization of temporary residence due to exceptional circumstances which may be granted to foreign nationals who are in Spain continuously for a minimum period of two years and are enrolled or currently studying some of the formations Those referred to in Articles 52.1.b) and 52.1.e) 5º of Royal Decree 1155/2024 (RLOEX) must either attend in-person compulsory education courses within adult education programs or commit to training promoted by the Public Employment Services in Spain aimed at performing occupations included in the catalog of occupations with shortages in the Autonomous Communities. Furthermore, they must demonstrate their integration into Spanish society through a social integration report issued by the Autonomous Community or, where applicable, by the City Council in whose territory the applicant has their habitual residence, as well as provide proof of having completed said training.

Requirements

  • Not being a citizen of a European Union State, from the European Economic Area or Switzerland, or a family member of citizens of these countries to whom the Union citizen regime applies. 
  • Being in Spain and not having the status of applicant for international protection at the time of submission of the application or during its processing. 
 

An applicant for international protection shall be understood to be a foreign person who has made an application for international protection on which a final decision has not been adopted in administrative and, where applicable, judicial proceedings. 

  • Having no criminal record in Spainand in the countries where he has resided for the last five years, for crimes existing in the Spanish legal system.  
  • Noto be listed as unacceptable in the territorial space of countries with which Spain has signed an agreement in this regard. 
  • Not to be found, where applicable, within the period of commitment not to return to Spainthat the foreign person has assumed upon voluntarily returning to their country of origin. 
  • Not to pose a threat to public order, safety or public health. 
  • Having resided continuously in Spain for at least the previous two years upon presentation of said application. In order for this requirement to be met, absences from Spain during this period cannot exceed 90 days.  
 

When the foreign national has been an applicant for international protection, The time spent in Spain during the processing of the application for international protection will not be taken into account.l until its final resolution in administrative and, where applicable, judicial proceedings. 

  • Be enrolled or currently enrolled in one of the following training programs:  
  • Completion of post-compulsory secondary education studies in an authorized educational center in Spain within the framework of a full-time program, leading to the attainment of a recognized qualification (art. 52.1.b) RLOEX). 
  • Completion of a complete training in an authorized teaching center in Spain, leading to the obtaining of professional certificates from the offers of the vocational training system of grade C, in its levels 2 and 3, with the requirements and conditions established in Organic Law 3/2022, of March 31, on the organization and integration of Vocational Training and its development regulations (art. 52.1. e) 5º) RLOEX), also includes level 1, as well as the face-to-face offer corresponding to compulsory education within adult education (art. 52.1.e) RLOEX). 
  • Likewise, foreign nationals who commit to undertaking training promoted by the Public Employment Services in Spain may apply for a temporary residence permit based on socio-educational integration. 
  • In addition to the above requirements, a social integration report in Spain will be required. 
  • Commit to completing training:
  • Promoted by the Public Employment Services and oriented towards the performance of occupations included in the Catalogue referred to in article 65.1 (Catalog of occupations that are difficult to fill). 
  • For these purposes, the proof of registrationmust accredit before the immigration office within a period of three months from the notification of the resolution granting the residence permit. 
  • Pay the fee corresponding to the processing of the procedure.  

Required documentation

  • Application form in official model (EX -10), duly completed and signed by the foreign person.
  • Full copy of passportregistration certificate or valid travel document, recognized as valid in Spain.
  • Documentation proving continuous residence in Spainfor a minimum period of two years. The documentation provided must contain the applicant's identification details and should preferably have been issued and/or registered by a Spanish Public Administration. For example, documents relating to registration with the local authority, hospitalization, a medical appointment in the public health system, as well as any municipal, regional, or national documentation that justifies presence in Spain will be considered.
  • Criminal record certificateissued by the Authorities of the country or countries in which you have resided during the five years prior to entering Spain.
  • Social integration reportissued by the Autonomous Community or, in which case, by the City Council, in whose territory the applicant has his habitual residence.
  • Commitment to completing the training, reflected in the official application form or in a written statement.
  • Registration for the planned training.
  • Mandate in favor of the manager.
