Family reunification

Description

It is a temporary residence permit that may be granted to the family members of foreign nationals residing in Spain, by virtue of the right to family reunification exercised by a resident foreign person.

Requirements

  • Not being a citizen of a European Union State, from the European Economic Area or Switzerland, or a family member of citizens of these countries to whom the Union citizen regime applies. 
  • Not to be in an irregular situation in Spanish territory. 
  • Lack of criminal record in Spain and in the countries where he has resided for the last five years, for crimes existing in the Spanish legal system. 
  • Not to be listed as rejectable in the territorial space of countries with which Spain has signed an agreement in this regard. 
  • Not to pose a threat to public order, safety or public health. 
  • Not to suffer from any of the diseases that can have serious public health repercussionsin accordance with the provisions of the International Health Regulations of 2005. 
  • Not to be, if applicable, within the period of commitment not to return to Spainthat the foreign person has assumed upon voluntarily returning to their country of origin.  
  • The sponsor must have sufficient fixed and regular resourcesfor their own support and that of their family members. The minimum amounts are as follows:  
  • For family unitsFor families with two members (the sponsor and the person being reunited), a monthly contribution of 150 times the IPREM is required. each additional member The 50% of the IPREM must be added.  
  • This amount may be reduced when dealing with minors and their legal representatives, and will be considered sufficient, even if it does not reach the aforementioned amount, when there is a stable source of income equal to or greater than the minimum interprofessional wage. In any case, if a family unit has two members, one of whom is a minor, the required amount will be 110% of the guaranteed amount of the Minimum Living Income annually, and for each additional minor, an additional 10% will be required. 
  • Having adequate housing
  • Have health insurancefor the person sponsoring the family reunification and the members of their family who have been reunited. 
  • If the person sponsoring the family reunification has other dependent children under the age of 18, compulsory schoolingAnd if they are already in Spain, they must be enrolled in school. 
  • The application for family reunification may be submitted when the foreign national sponsoring the reunification has resided in Spain for at least one year and has applied for authorization to reside for at least another year., with the following exceptions:
  • That the person sponsoring the family reunification holds a long-term or long-term EU residence permit granted in Spain, for the reunification of their ascendants or the ascendants of their spouse or partner. 
  • That the person sponsoring the family reunification is resident in Spain based on their previous status as a long-term EU resident in another Member State of the European Union. 
 

The residence permit cannot be granted to the family member being reunited until, depending on the situation that the sponsor must hold in order to exercise the right, the sponsor's permit has been effectively renewed, or their long-term residence permit or long-term EU residence permit has been granted in Spain.

Family members eligible for family reunification

The reunited family member it may be

  • Spouse or person, over 18 years of age, with whom the person sponsoring family reunification maintains a relationship of affection analogous to that of a spouse. Under no circumstances may more than one spouse or partner be reunited. Marriage and a similar relationship of affection are incompatible. In the case of remarriage, proof of the dissolution of the previous marriage and the status of the former spouse or partner and their family members must be provided, including details regarding the shared residence, spousal support, and children.

Required documentation

  • Application formin official model (EX – 02), duly completed and signed by the foreign national sponsoring the family reunification.
  • Mandate in favor of the manager.

Documentation relating to the sponsor

  • Copy of full passport, travel document or valid registration certificate of the applicant.
  • Copy of documentation proving that you have employment and/or financial resourcessufficient to meet the family's needs. To demonstrate this, you may submit:
  • In the event of carrying out a lucrative activity by someone else's account:
  • Copy of the employment contract and payslips for the last six months.
  • In your case, the latest personal income tax return.
  • In the event of carrying out a lucrative activity by self-employed:
  • Accreditation of the activity carried out.
  • In your case, the last personal income tax return or the last two quarterly personal income tax returns.
  • In case of not to engage in any profit-making activityIn Spain: certified checks, traveler's checks or payment letters or credit cards, accompanied by a bank certification of the amount available as credit on the aforementioned card or bank certification.
  • Documentation proving the availability of suitable housing:
  • This condition This will be proven by providing the report issued by the competent body of the Autonomous Community where the sponsor resides.. The report may be issued by the Local Corporation when so established by the Autonomous Community.
  • Health insurance for the person sponsoring the family reunification and their family members eligible for reunification.

Documentation relating to the family member to be reunited

  • Full copy of the complete passport or a valid travel document.
  • Copy of the documentation proving family ties or of kinship or of the existence of a de facto union and, where applicable, of legal and economic dependence.
  • In the case of reuniting with the spouse or partner:
  • Sworn statement from the sponsor that no other spouse or partner resides with him in Spain.
  • If married in a second or subsequent marriage, a court order establishing the status of the former spouse and their children.
  • In the case of children:
  • If they are reunited by only one parent: documentation proving that they exercise sole parental authority, have been granted custody, or that the other parent authorizes their residence in Spain.
  • If they are over eighteen years of age and are not objectively capable of providing for their own needs, supporting documentation.
  • If they are adopted children, the resolution by which the adoption was agreed.
